Facility Hire Terms and Conditions

By using this website, and utilising any recreation/meeting facilities provided by Northern Midlands Council (NMC), you accept these terms & conditions and agree to comply with them. If you do not agree to these terms & conditions of use, you must not use our website or utilise any facilities provided.

Introduction

NMC respects your privacy and is committed to protecting your personal information. These terms & conditions, together with other information on this webpage, will inform you as to the full conditions you are agreeing to.

Bookings and Payments

  • All transactions are processed in Australian dollars.
  • All bookings must be paid no later than the day the booking takes place.
  • NMC management reserves the right to place a "payment in advance" term on any booking. Any booking subject to this condition will be advised of this condition by NMC management prior to confirming the booking.

Cancellations, Payments, Refunds, Credits.

  • Fees for usage are prescribed in the NMC fees & charges schedule for each facility.
  • Deposit of 25% of hire fee is payable to confirm bookings.
  • A minimum of 14 days notice must be provided to Cancel or Change a booking. Less than 14 days notice and you will still be charged the full hire fee.
  • Bonds do not apply to government users including schools.
  • Refunds are not provided for any/all bookings (unless cancelled as above).
  • No credits are provided for any/all bookings.
  • NMC management reserves the right to place a "no cancellation" term on any booking. Any booking subject to this condition will be advised of this condition by NMC management prior to confirming the booking.
  • Local residents of NMC receive a discount of 25% off all hire fees.
  • Individual hire agreements apply for membership based clubs/organisation(s).
  • Members of the Campbell Town Football Club, Campbell Town Tennis Club and Midlands Magic Netball Club receive a 50% discount of all hire fees.

Coaching Programs

  • Unless otherwise authorised by NMC management, no commercial activities are permitted at facilities other than those conducted by Council.

Participants with Medical Conditions

  • NMC staff do not supply and/or administer any form of medication to any person utilising the facilities, a small first aid kit is available onsite only.

Security and Safety

  • Some areas of the facilities are covered by a CCTV network.
  • Anyone identified as being abusive and/or violent on the premises of NMC may be banned from entry.
  • Any illegal acts may be referred directly to the police by NMC.
  • Kicking, throwing, playing with any ball is not permitted in any area of the facilities other than on courts or on the oval.
  • No climbing of fences and buildings is permitted.

Footwear

  • Players of sport must wear appropriate footwear.
  • Football boots, or any boots with spikes or pegs must not be worn inside the building on carpeted areas.

Alcohol and Smoking

  • Alcohol and/or smoking are only permitted on the premises in designated areas.

Animals

  • No animals, other than certified guide dogs, are permitted on the premises.

Food and Drinks

  • Food and/or drinks of any form are not permitted on the courts or on the oval without prior permission from NMC.
  • Glass bottles are not permitted on the courts or oval for safety reasons.
  • Chewing gum and/or bubble gum are not permitted in the premises.

Liability & Insurance

  • NMC maintains current public liability insurance and workers compensation insurance policies.
  • All persons entering the premises of NMC accept responsibility for any injury or illness arising out of or in connection with their participation in activities at the premises. Private health insurance may cover injury or illness arising out of or in connection with their participation in activities at the premises but please check with your own insurance provider as this statement is not insurance or legal advice.
  • All persons entering the premises of NMC release and discharge NMC, its employees and agents from any claim, suit, demand, expense or cost in respect of any injury or illness arising out of or in connection with their participation in activities at the premises.
  • Any person(s) using NMC facilities to play netball, tennis and Australian rules are to be covered by their club insurance policies. This point does not in any way contradict Point 2.
  • Any person(s) using NMC facilities for play or training in netball, tennis and Australian rules, and all other contact sports is NOT covered by NMC insurance policies and they do so at their own risk and accept responsibility for any injury or illness arising out of or in connection with their participation in these activities at the premises of NMC. NMC hires courts and/or the full field at the premises to the person(s) on the basis that they understand and accept this condition of use, and that they inform any other person(s) who may be participating in activities on the courts or oval hire.

Permitted Activities

  • No commercial activities of any/all forms are permitted at NMC facilities other than those conducted by NMC, unless otherwise authorised by NMC in writing. Any person(s) or organisation(s) identified as conducting such activities without the written authority of NMC may be banned from the facilities.
  • NMC reserves the right to ban any activity at NMC facilities that management deems inappropriate use of the facilities. Any person(s) or organisation(s) identified as conducting such activities may be banned from NMC facilities.

DISCOUNTS

  • Local residents of NMC receive a discount of 25% off all hire fees.
  • Individual hire agreements apply for membership based clubs/organisation(s).
  • Members of the Campbell Town Football Club, Campbell Town Tennis Club and Midlands Magic Netball Club receive a 50% discount of all hire fees.

DEBT COLLECTION

Debt Collection Action

You authorise NMC to notify any debt collection or credit reporting agency upon default by you in regard to any obligation to pay under a hire request. You may be liable for any costs associated with the recovery of your overdue account, and outstanding fees, but is not limited to legal fees, interest and mercantile agency collection cost.
